10. Jurisdiction
FocussedGrowth.com is based in North Carolina, United States. This privacy policy and our data practices are designed to comply with applicable U.S. federal and state laws.
11. Dispute Resolution and Arbitration
11.1 Agreement to Arbitrate
By using our Site, you agree that any dispute, claim or controversy arising out of or relating to this Privacy Policy or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration rather than in courts of general jurisdiction.
11.2 Arbitration Procedures
The arbitration shall be conducted by an arbitrator or arbitration service selected at FocussedGrowth.com’s sole discretion at the time a dispute arises, provided that the selected arbitrator or service is a neutral third party recognized for handling commercial disputes. The arbitration may be conducted in person, through the submission of documents, by phone, or online.
The arbitrator shall have the power to rule on their own jurisdiction. Notwithstanding FocussedGrowth.com’s right to select the arbitrator, the arbitration will be conducted according to established rules that ensure procedural fairness, and the user retains the right to challenge the selected arbitrator for bias or conflict of interest according to those rules.
If a North Carolina or Federal court finds this untenable, then the arbitration shall be conducted by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator shall have the power to rule on their own jurisdiction.
11.3 Class Action Waiver
Any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial.
11.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency equitable relief in federal or state courts in North Carolina only in circumstances where irreparable harm would occur before an arbitrator could be appointed. Such relief shall be strictly limited to temporary measures necessary to preserve the status quo pending arbitration, and the court’s involvement shall terminate once an arbitrator is appointed.
Both parties consent to exclusive jurisdiction and venue in such courts for this narrow purpose only. The arbitrator shall have authority to modify or dissolve any temporary relief granted by the court. FocussedGrowth.com reserves the right to seek attorneys’ fees and costs if a user seeks court intervention in violation of this arbitration agreement.
11.5 Governing Law
This Privacy Policy and any arbitration shall be governed by and construed in accordance with the laws of the State of North Carolina and that of the federal government , without regard to its conflict of law provisions.
